Defending against pornography, child pornography possession and distribution charges

Both state and federal penalties apply to pornography convictions. In Minnesota, someone who distributes or promotes child pornography is guilty of a felony, punishable by imprisonment up to seven years, a fine up to $50,000 or both. Someone who possesses child pornography, and Minnesota courts define that as merely viewing on a computer screen, is guilty of a felony punishable by imprisonment up to four years, a fine up to $10,000 or both. Registration as a sex offender and restitution may also be required.

Defending against solicitation of a minor

Anyone who accosts, entices or solicits a child under the age of 16 with the intent to induce or force the child to commit an immoral act or a sexual act is guilty of a felony, punishable by imprisonment for up to four years and a fine up to $4,000 or both. It does not matter, according to Minnesota statute, whether you know the actual age of the child or believe the child was less than 16 years old.

If the solicitation occurs using the Internet, penalties for the felony vary depending on the underlying crime and could lead to a maximum of 20 years, a fine up to $20,000 or both.
